Law firm Harper Macleod LLP has advised FCS throughout the process, with Partners David Bone and James McMorrow providing support to FCS’s in-house procurement and renewable energy teams and negotiating commercial terms. The Harper Macleod team will also draft land agreements as part of FCS’s drive to increase its contribution to generating clean and renewable energy through more wind and hydro energy projects on its land.
The development area covers Inverness-shire, Ross and Skye, Lochaber and the northern Highlands and is the first of three lots that are open for small-scale hydro development. The first successful development partner, Green Highland Renewables Limited, will now identify suitable schemes and potential sites for development. FCS is also currently in discussions with prospective development partners for the development of wind farms on the National Forest Estate. Harper Macleod is currently advising the Forestry Commission in relation to this process.
Harper Macleod’s work within the Energy sector has grown substantially over recent years, becoming a key revenue-generator and area of focus for the firm. The firm organised high-profile events earlier this year such as the first Scottish Highland Renewable Energy Conference in Inverness and the Introduction to Renewables seminar in Edinburgh (collectively attended by more than 350 delegates). With the appointment of David Bone in March (who is described by Chambers legal directory as having "been involved in more wind farm work than any other human being") to head the Energy & Natural Resources Practice Group, the team has further enhanced its reputation, and recent client wins show that their expertise is much in demand.
The firm has an enviable client list ranging from large and small-scale developers through to landowners and planning authorities and their work covers all aspects of energy developments including on and off-shore wind, coal, hydro, biomass, wave & tidal and solar.
